Contentious contracts often breed fights over earnest money if the contract is terminated. This course will examine such issues as: (1) what to do when earnest money is forfeit due to a failure to address a contingency within the timeframe required under the contract; (2) what to do when the other party to an escrow won’t agree to a release; (3) litigation tactics; and (4) negotiations tactics. The advantages of not holding earnest money and the alternatives to consider.
